1. Scope
These Terms & Conditions apply to all sales of eyewear products (hereinafter “Products”) offered under the brand Agfacolor via our online channels. By placing an order, the customer accepts these Terms & Conditions.
2. Contract Language and Storage of Contract Text
Contracts can be concluded in German or English.
We do not store the full contract text for the customer. Order details and Terms & Conditions are sent by e-mail after purchase and can be viewed in the customer’s account, if applicable.
3. Delivery Times
Unless otherwise stated, delivery time is approximately 3–5 business days within Germany and up to 4 weeks for handcrafted or unique products. Delivery times for international orders may vary. Customers will be notified immediately in case of delays.
4. Prices and Payment
All prices include applicable VAT (if required by law). Shipping costs are displayed separately during checkout. Payment must be made in advance through the payment methods offered on the website (currently PayPal and credit card).
5. Right of Withdrawal (EU Customers)
Consumers within the European Union have the right to withdraw from the contract within 14 days without giving any reason. The period begins on the day the customer receives the goods.
To exercise the right of withdrawal, the customer must send a clear statement (e.g. e-mail or letter) to us.
Exclusion: Custom-made or personalized glasses (e.g. prescription lenses) are excluded from the right of withdrawal.
Return Costs: The customer bears the direct costs of returning the goods.

6. Voluntary Return Policy (Non-EU Customers)
For customers outside the EU, Agfacolor grants a voluntary 14-day return option under the same conditions as for EU customers. This voluntary policy does not affect any mandatory statutory rights that may apply in the customer’s country of residence.
7. Product Characteristics
Our eyewear frames are made from natural materials such as wood. Variations in color, grain, and texture are inherent characteristics of natural wood and may change over time. These variations are a natural feature and do not constitute a defect.
8. Returns Procedure
Returned goods must be sent back in their original condition and packaging. Products that show damage due to improper use, handling, or alteration are not eligible for refund.
9. Warranty and Guarantee
We provide the statutory 2-year legal warranty for defects under German and EU consumer law.
In addition, we provide a 1-year guarantee on sunglasses for defects attributable to manufacturing errors. This guarantee does not cover damage resulting from improper use, accidents, or breakage due to external forces.
Liability for damages caused by improper use, storage, or modification of the product is excluded.
Mandatory statutory liability (e.g. for intent, gross negligence, injury to life, body, or health) remains unaffected.

11. Applicable Law and Dispute Resolution
These Terms & Conditions are governed by the laws of the Federal Republic of Germany.
For consumers within the EU, this choice of law does not affect mandatory consumer protection provisions of their country of residence.
The European Commission provides an online dispute resolution platform (OS platform): https://ec.europa.eu/consumers/odr.
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
Right of Withdrawal / Widerrufsbelehrung (EU Customers)
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period will expire after 14 days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the goods.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not obligatory.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (except for additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.
We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.
You will bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods which are made to the consumer’s specifications or are clearly personalized (e.g. prescription lenses).
